We reserve the right to suspend or terminate accounts that violate these Terms, engage in unauthorized activity, or are inactive for extended periods.
4. Services Provided
Tickin offers workforce management solutions, including but not limited to:
- Attendance tracking via geo-location
- Shift scheduling
- Employee loyalty and rewards programs
- Leave management
- Document storage and contract management
- Real-time dashboard and reporting tools
These services are subject to change at Tickin’s discretion. We will notify users of any significant modifications or updates.
5. User Conduct
By using Tickin, you agree not to:
- Use the platform for unlawful purposes.
- Violate any applicable laws or regulations.
- Share, transfer, or distribute data without the necessary permissions.
- Infringe upon Tickin’s intellectual property rights.
- Upload, post, or transmit any harmful or malicious code.
- Attempt to gain unauthorized access to Tickin’s systems or data.
6. Data Collection and Privacy
Your data will be collected, processed, and used as outlined in our Privacy Policy. By using Tickin, you consent to our data handling practices, which may include using anonymized data for research, marketing, and service improvement purposes.
7. Fees and Payment
7.1 Subscription Fees
Tickin offers subscription-based access to its services. Fees for each subscription tier are outlined on our Pricing page. By subscribing, you agree to pay all applicable fees.
7.2 Billing
Subscription fees are billed monthly or annually, depending on the plan you select. All payments are non-refundable unless stated otherwise in these Terms.
7.3 Late Payments
Tickin reserves the right to suspend or terminate services if payment is overdue. We will attempt to notify users in advance if service disruptions may occur due to non-payment.
8. Intellectual Property
Tickin retains ownership of all intellectual property rights related to the platform and its content, including trademarks, logos, software, and related materials. You may not copy, distribute, modify, or create derivative works from any Tickin content without prior written consent.
9. License and Restrictions
Tickin grants you a limited, non-exclusive, non-transferable license to use the platform solely for your organization’s workforce management purposes. You may not:
- Resell or sublicense the platform.
- Reverse-engineer, decompile, or otherwise attempt to extract the platform’s source code.
- Use the platform to build competing products.
10. Third-Party Services
Tickin may integrate with third-party services for additional functionalities. Your use of third-party services is subject to their terms and conditions. Tickin is not responsible for third-party services or any issues arising from their use.
11. Limitation of Liability
Tickin and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising out of or related to your use of Tickin, even if we have been advised of the possibility of such damages.
Our total liability to you for all claims related to the use of Tickin shall not exceed the amount paid by you for the service in the last 12 months.
12. Indemnification
You agree to indemnify, defend, and hold Tickin harmless from any claims, losses, damages, liabilities, and expenses arising out of your use of the platform, your violation of these Terms, or any infringement of third-party rights.
13. Disclaimer of Warranties
Tickin is provided "as is" without any warranties, express or implied. We do not guarantee that the service will be uninterrupted, error-free, secure, or free of harmful components. Tickin disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Changes to the Terms
We may update these Terms of Use periodically. We will notify you of material changes via email or a notice on our platform. Continued use of Tickin after any changes constitutes your acceptance of the updated Terms.
15. Termination
Tickin reserves the right to terminate or suspend your access to the platform at any time for any reason, including, but not limited to, violation of these Terms or suspected fraudulent activity.
Upon termination, you must discontinue all use of the platform, and all rights granted to you will immediately cease.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of laws principles.
17. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms, the parties shall first attempt to resolve the matter through amicable negotiations. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in Dubai, UAE.
